Okay, some of you may remember I was railroaded and hung out to dry by the BIG BOSS at my last employer when I was working for the state.

I just learned she did the same thing to another guy whom work in our department.

She did this to seven people from that department. I was number six and this guy is number seven. She rids anyone whom disagrees with her.

He saw me today and walked up to me and gave me a hug. It took me a second to realize who he was. Then, I remember, Turns out they made him resign or he would have been terminated because he was watching a boring arse programming movie about migrating databases etc. and he dosed off for a few seconds which in the state system is a class three automatic firing. He was told they would not issue the class three if he resigns because she was likely afraid he would draw attention to her low handiness practices. Not knowing exactly what happen to me, he resigned.

He's also been having a rough time personally as he's in a divorce situation with teens.

He apologized for not being there for me when I was forced out knowing I had a three year old, a five year old and and right year old. I told him I understood.. and if he would have spoke up a year and half ago his head would have been on the chopping block sooner. There was nothing he could do, they wanted be out and I so the writing on the so I quit. Now she's done it too him.

She continues to reep the STATE rewards and steps on everyone under her.

She an arse, a terrible human being, that heartless, gutless and an overall piece of shit. She deserves to lose something. Her job her personal business or something.

What can I/WE do that's legal or..... that would draw attention to them and there wicked practices.

People like that burn me up, and I swear it's a good thing I quit when I did.

Perhaps if the seven of us join together to tell our stories to a committee at the U something would/could be done. Perhaps a class action lawsuit against her or something.

The down side is UVA is the biggest employer in C'ville and the power she has is great and those head managers tend to wipe each others arse.

If we sue I'd probably loss my job but I really don't care right now. The problem would be getting the others involve. I think out of the seven of us only four would step forward for fear of losing current positions.

They need to know they can't do this to staff employees with out a fight. It happening over and over at the U and something needs to get out to the right people.

Man, if there's seven of you then I'd think that definitely shows a pattern. Were all male? If so you could possible go down the discrimination route.

I'd say, if you can get in touch will the other six and maybe get written statements then talk to an employment attorney.

You could all get together and call her out on that time she sexually harassed you. Remember that? I sure do. It was awful. She touched your boob and everything. :devious

Oh, they should all step forward, the CANNOT let you go (retaliation) esp. a gov't job.
Good luck,
C

If all the fired are male that could definately go towards indicating a pattern, I would start with an EEO Commission complaint. If you have contacts that are under her supervision now that would complain it would seem to go a ways toward eliminating the appearance of a bunch of disgruntled ex-employees seeking revenge...it would also go a ways toward securing their positions as any termination would appear in response to the EEO complaint. Pick up the Yellow pages and call a labor attorney for a free consult.

Did yousign a contract when you took on your old position? If so, I'd geta copy and read it carefully. Then, I'd talk to a State attorney that deals in labor affairs. There has to be a version of Internal Affairs or Inspector General that is outside the loop, but still able to force matters be settled properly. No union? Well, read the contract first. You could get in deep doo doo if you incriminate people based on things well within their rights.

I have a Federal GS employee (now NSPS) as my boss (I'm military). That bastard is slowing self-promoting himself to higher positions, violating federal contracts, and abusing his power because no one will stand up against him. I did. I wrote a letter to the Inspector General which resulted in one of my other bosses telling me to shut up and color. So, when my civilian boss found out what I did, he called me into his office for a one-on-one meeting. Big mistake. Never go into a closed door office with the a**hole you just turned in for lying! As soon as I saw the door close, I went the f**k off on him and left. He couldn't do anything to me becuase he had no witnesses (his mistake). I drew first blood and left before he could say a word.

Moral of the story is if you prosecute someone, get ready for the shitstorm to follow. The government (state and federal) at all levels is internally corrupt. I wish you luck. I'm running away from government jobs while I still can.:banghead

Is your current job better than your last one?

Mrs. Duke sat on a jury which heard a wrongful termination case. The plaintiff was a manager at The Yard House, a prominent restaurant/bar in Long Beach which employs hottie waitresses. Seems that screwing the owners and putting up with ass grabbing sexual harrassment was part of keeping the job and getting the good shifts for these young ladies. The wealthy owners drove around in their exotic sports cars and screwed hot young women who were half their age. Such a California situation... fast cars, pretty women, money, sex, power. Another day in LA!

The manager took pity on the waitresses, complained about the harrassment and he was fired. Turned out he got a higher paying job as a manager at another restaurant and married one of the hottie waitresses. Mrs. Duke was the only juror who saw something wrong - the others had the "no harm no foul" attitude.

The lawyer representing the manager was old and tired. The 3 lawyers representing the restaurant owners were the "dream team", young and slick. The testimony from the now ex waitresses was titilating :devious All that and he still lost.

If you take this up, recognize you have an uphill battle. :banghead

:confused He fell asleep on the job (a known automatic firing offence) got the option of resigning or being fired and chose resignation?

Why is he #7 and it's her fault?

She might be a bitch and followed a hard line, but was she responsible for him falling asleep? :dunno

handing it on

God grant me the serenity To accept the things I cannot change; Courage to change the things I can; And wisdom to know the difference.
tough call del.

there are a few different perspectives cited so far. One thing I do know is life is a great leveller. She may be a classic workplace bully, she may be critically incompetent, but she is in the position and that is basically unchangeable.

you could.
1) send her a card explaining your view on her actions and behaviour.
2) meet her for coffee and explain your view etc.
3) write to her boss and explain...................
4) hand it over to God
5) send the card or do coffee then hand it on to god.

item
1) could make you feel better if it gets it off your chest, could improve her practice and behaviour if she takes it on board,
could make you feel worse if she rejects you r input.
minimum gain, you would have spoken your piece.

2)see item 1

3) could make you feel better if it gets it off your chest, could improve her practice and behaviour if she takes it on board,
Involves you relying on someone more powerful to act on your behalf and suggests disciplinary approach.
minimum gain, you would have spoken your piece.

4) Gives you the freedom to move on right now without the need for an outcome.

5) informs her she has had an effect on another for which she may have some responsibility, and then lets you move on.
minimum gain, you would have spoken your piece.

It comes down to what you want for yourself from all of this.

I think that the global problem comes about when as individuals we feel overpowered by a boss or peer.
certainly in the same position again I would recommend you immediately involve a workplace representative or a more senior employee.
some rules are applied without thought for circumstance and senior staff can apply wisdom in decision making. It makes the playing field flatter and disempowers bullies, makes issues public and paves the way for reform.

personally I took onboard the advice of a friend many years ago and that was to think of those following after me. I have left many jobs for many reasons but I have left with all concerned being well aware of my reasons for going!!

I might add that I now work for myself ( I am the only one left to employ me)

LONG brief period of five years of hell. First three I was not aware of until after I was targeted.

No the race is not a factored except she does hate blacks but there is no proof of that. In fact, to have minority in the office she hired a black Computer tech to replace me. I resign because I already had one level two offense against me for leaving a cd in a computer. A security offense so they said. They were looking to nail me to the wall unknowingly to me and that was there ammunition. I saw the writing on the wall a year and a half ago two weeks before my dad passed. The bastards did not even send me condolences when my father passed away.

My current position is not like that and not with the state. I support the state but I work for a private company, however, if I was to cause a stink, I'd probably would be dismissed. The gender and race was like this. She covers her arse really well for a non married, non children middle age woman.

The best news is at least she has no-one I'm aware of to teach her ways too.

Anyways.

First person was career employees whom fault the so call state system tooth and nail but ultimately they force her to resign. Her health depended on it because of stress.

Made up names just because but helps explain better with names I think.

1. Cindy: White in her 60's I think.
A Life time employee 30-35 years with the state. She knew her job well.

The rest of us including me saw what was going on and did nothing in fear. Maybe it won't happen to me. Maybe... there reasons for the way she being treated, maybe I can get out of here before it does come my way. yada yada, yada.

2. Mendy: White young, lesbian, open attractive. They beat her down every chance they got with writing her up for whatever. Very talented with art and organizing graphic materials for the student handbooks etc. She.. like me had a fire in her when mess with and like me was unable to control her temper. She was fired because of her previous BS warning's constantly being written up etc.

3.Tracy A faculty member, open lesbian her job was a contract position and she knew she was screwed. She did everything she could to bring attention to the issue but the rest of us ****ed up and protected the bitch to some extend because we were not being affected, nor did we know exactly what was going on, that is until it's your turn. Her contract was not renewed and she was let go. Tracy was Mandy supervisor and she was let go because
The BIG boss found a way to remove her from the office for the remainder of her contract because she was unable to get rid of a black employee (Sandy) whom did her job and did it well, also lowest paid in the office. Sandy filed a discrimination charges against the faculty member “Tracy” directed by BIG BOSS. Remember both where doing what she told them to do. ‘How do I know” I spoke to both of them after they where let go. She was also putting pressure against my boss whom put unreasonable pressure against me. Meanwhile, the jiving bitch (bog boss) remain untouched while everyone bickered and tried to protect her and there own arse. Meanwhile...she was orchestrating the entire damn thing behind close curtains and pushing all the buttons.

The BIG Boss even talked to me and pretended to give a damn about my situation. She offered bull shit advice about bridging the gap between me an introvert and my boss by explaining technology on his level. My boss was not a techie person but he was not an idiot. I was. Like everyone else I believe her hype and thought it was a personal problem with him, when it was her. Became evident when I resigned.

4. NEW hire Whitney

Black, recent college graduate, attractive, I believe she was a lesbian. Not open

Also White college graduate Amy attractive, lesbian, I think not open.

5: Gibson Male openly gay, middle age. He knew everything about the department worked his way up the ladder and he should have had the BIG BOSS’s position but somehow she got it. The problem he over shadowed the big boss. With him around all things achieve and done was because of Gibson oversight. He had to go.

Gibson played his cards well and hide the truth from all of us. I confided in Gibson when I was being railroaded and he told me he knew what I was going through. He landed a great job with in the infrastructure but at least the big boss had him out of her way.

6: Whitney seem to be moving up the ladder rather quickly doing Tracy's stuff whom was removed from the office while her contract tinkered along. Something happen. Whitney went to lunch and an email was sent out stating she quit. No warning to any of us whom talked to her regularly. Wow that was weird.

side note Amy serves her term for about a year. She was gold they made such a fuss over her and she receive an undisclosed amount of money and gifts as going away presents. I think it was under $1000.00

7. Sandy, black single mom lowest paid filed the race issue against her previous sup.(Tracy) She thought she was in the clear. I knew better, I told her that shit was looking bad and I think the entire Tracy :bs was a coverup.

8: Me, Written up on a level two offense. I did not file a grievance's I was left with the impression that would not help the issue. Instead I accepted the charged and worked to figure out how to do something better. Remember that September accident in 2006 when I fractured my hib. I was out of work for six weeks. I went back was was told to updated the list of surplus hardware found in the storage closet I said sure. Nothing had change to my knowledge. I was unable to get to the top shelfs as I could not climb a latter at that point. When instructed to do so I refuse and went to HR about the issue. No excuse stating I was not 100% so they plan to write me up for a second level two offense which I could grief. I curse at them and then HR and gave my two weeks. Then two weeks later dad passed away.

9: Lindsey retired by being forced out for heath reasons and yada, yada, yada.
I believe she would still be there if not because of the big boss.

10. Programmer hired while I was there, going through a divorce which I had no clue about and bam makes a mistake (fell asleep while at work immediate level three tenure with the system etc so he had to resign rather then be fired because of his tenure with the VRS system

You know what. :idea

Long shot

Perhaps, I will seek out the untold, unknown stories. Maybe I can and write a freaking book on "The corruption's and inside dealings of unfair practices and judgments against employee's at Universities across America by the ones in charge"

3) write to her boss and explain...................
Result: Libel, slander lawsuit with causes of action for defamation of character, intentional infliction of emotional distress, interference with prospective economic advantage. Del's homeowner's insurance does not pay to defend or indemnify him for these non covered personal injuries. Del defaults on the lawsuit as he can't afford a lawyer, mean bitch boss takes it all the way, resulting in judgement leading to a lien against Del's home. Del does not have to sell the home due to Homestead laws, but the lien makes the property worthless.

Don't do it buddy. Let it go :lol

Del,

The Commonwealth has a strick wistle blowers and non retaliation laws. Go to her Supervisor with documentation of your allegations (P&P manuals, handbook, etc.), and also let another Supervisor you trust aware prior so you have a fall back option. Then if all else fails, do what Edward Norton did when he was going to lose his job in fight club.

Install a keystroke logger on her computer and have it send the data to an email account that you. I am sure you'd find something to screw her over with in the info, or at least you could get passwords for her email, then send out emails from her that are completely inappropriate and/or incriminating.

I'm no longer there. I quit a year and half ago. Yeah at one time I could have really did her in but probably too late now. It just kills me because they did something similar to another person I cared for while there. The only ones there now are her pet peeves and the lifters whom can't wait to get out.

The laws are there yeah but it's :bs Basically just a stamp on a piece of paper that's never being mail. It's there for image. They may work for a select few but for most they don't

I learned going through my ordeal that nothing is secret from management even when it's suppose to be.

Del, just thought of something else. When I was in the army, we always had issues. If you had a squad leader that was constantly getting his people Article 15's (non-judicial punishment) for something, he thought he was doing good. All the rest of us NCO's and officers looked at it like "why wouldn't this jackass protect his people? Instead he's constantly punishing." In the end, he was demoted (not literally, just to positions with no authority and noone underneath him) the command felt it showed more about him than the troops.

So, maybe you can querry her boss in the same fashion. Doesn't 7 firings show that she doesn't know how to manage people? Was the mission completed on time and in spec? Productivity is higher when people aren't afraid to go to work or make mistakes.

just a thought,
C
